TERMS of SERVICE

Upon payment of invoice, to any capacity, customer accepts the following terms:1. Unless otherwise discussed, the final piece is for personal, non-commercial use.* Reproductions or alterations of the final piece for monetary purposes such as, but not exclusive to, merchandise, NFTs, blockchain and/or crypto, AI work or AI data training or resale are STRITCLY PROHIBITED. Violation of this will lead to a permanent blacklist for future pieces and loss of rights to artwork.
*Commercial Rights Clause
Commercial use of final product (such as merchandise creation and sales) may be negotiated, but must be agreed upon by both parties prior to the invoice and there will be an additional charge for purchasing additional commercial rights.
2. Payment is upfront via Paypal, Ko-Fi, or Stripe invoice, and no refunds without prior discussion are permitted. Communication is important, and I would appreciate that any issues be communicated before decisions are made. Attempted chargebacks without discussion at any point will be noted as a violation of ToS, and will lead to an immediate and permanent blacklist. Payments made to me outside of a formal invoice will be considered a donation or tip. I do not accept random payments for commissions that I have not agreed to/have not provided an invoice for.
Payment plans are available for larger commissions. Each portion of the payment plan will contribute towards the completion of a portion of the final piece.
3. Acknowledgement that the final product is digital. Final product will be sent via email and no physical version of the product will be mailed. Larger commissions may be shared through an online drive. In either scenario, it is the customer’s responsibility to download an offline copy for themselves to keep.4. I, GlitchMothLu, retain copyright of the final artwork. I may continue to post and feature the final commission on social media, in portfolios, and other related forms of marketing and advertisement. If desired, the customer may pay an additional non-disclosure fee to keep WIPs offline and private. As progress shots are often used to advertise my services, this NDA fee compensates for lost marketing.

"Can I request a speedpaint of my order?" Yes, but there will be an additional charge and will need to be requested during the planning process. If you request it after I've already started the speedpaint would be incomplete, after all."Can I request a print?" I do not currently have the plans nor the means to do physical prints. This may change in the future, but I have no plans for it, no."What do you mean by "acceptable commercial use"?" Commercial use is defined as the intention to use merchandise, tools or an IP (intellectual property) for financial gain. No matter how little the return is, if you are interested in using my artwork to make money for ANY purposes, it would be considered commercial use. If you have the intention of making sellable merchandise (shirts, charms, stickers, prints, phone cases, etc.) where you would be profiting additionally from my work, you would need to purchase additional commercial rights.
Examples of "acceptable commercial use" (i.e. commercial use where an additional charge will not be required) would be: social media banners/profile pictures/advertisements, streaming assets, promotional artwork, Vtuber/Live2D/PNGtuber assets, etc. Credit would still be required.
